These Terms of Service (the "Terms") form a legally binding contract between you and Technooptics ("we", "us", or "our"), the operator of Rolls & Digs (the "Service"). Please read them carefully — by creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms.
Specific features and country-specific terms may apply in addition to (but not in conflict with) these Terms; where they conflict the more restrictive rule controls. The Privacy Policy, Safety Policy, Community Guidelines, and Acceptable Use Policy are part of these Terms by reference.
1. Agreement to terms
If you do not agree to these Terms, do not use the Service. By clicking "I agree", ticking the acceptance box on sign-up, or by continuing to use the Service after a material change is announced, you agree to be bound by the then-current Terms.
2. Eligibility
You must be at least 18 years old and hold a valid driver's licence in your jurisdiction to use the Service. By creating an account you represent and warrant that both are true, that all information you provide is accurate, and that you are not a person barred from using the Service under the laws of the United States or any other applicable jurisdiction. The Service is not directed to children under 18.
3. Your account
You are responsible for safeguarding your account credentials — including any passkey, password, or magic-link email address you register — and for all activity under your account, whether or not authorised by you. Notify us immediately at contact@technooptics.org if you suspect unauthorised access. You may not impersonate another person, misrepresent your identity, share your account, or maintain more than one account except as expressly permitted. You may close your account at any time from your profile.
4. Sanctioned use only — no public-road racing
The Service is intended exclusively for use on (a) closed courses, (b) sanctioned drag-strip, road-course, oval, karting, autocross, or rally events, or (c) private property with the owner's consent. You may not use the Service to plan, conduct, time, broadcast, advertise, or record races or speed runs on public roads, highways, or any property where motor-sport activity is not lawfully permitted.
Public-road racing is illegal in essentially every jurisdiction and is a leading cause of preventable traffic deaths. We reserve the right to suspend or terminate accounts that show patterns consistent with public-road use, and to disclose information to law-enforcement when legally required.
5. Assumption of risk & release
Motorsport activity is inherently dangerous and may cause serious bodily injury, death, and property damage. To the fullest extent permitted by law, you voluntarily assume all such risk. You release, waive, and hold harmless Technooptics, Rolls & Digs, our officers, employees, contractors, sponsors, partners, and other users from any and all claims, demands, losses, costs, or liabilities (including legal fees) arising out of or related to your use of the Service, your participation in any related event, or your operation of any vehicle.
6. The Service is not a safety system
The Service provides telemetry tools, lap timers, social features, AI assistance, and informational content. It is not a certified safety system, official timing system, race steward, navigation system for emergency use, or substitute for professional driver training, a tech-inspected car, or qualified medical / mechanical / legal advice. We make no representation that any reading, prediction, alignment indicator, traffic alert, hazard pin, jump-start detection, or countdown is fit for any particular use, and you may not rely on any of them as such.
7. Your content
You retain ownership of content you upload — cars, photos, videos, build notes, mod lists, race traces, lap times, posts, comments, group submissions, and so on ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to host, store, reproduce, modify (e.g. compress, transcode, crop), distribute, publicly display, and create derivative works of Your Content, solely for the purposes of operating, providing, improving, marketing, and securing the Service.
You represent and warrant that you own or have all necessary rights to Your Content, that it does not infringe anyone else's rights, and that its publication will not violate any law. You are solely responsible for Your Content.
8. Acceptable conduct
You agree not to (without limitation): harass, threaten, bully, defame, or stalk other users; post or transmit unlawful, hateful, violent, or sexually explicit content; collect or harvest other users' data without permission; reverse-engineer, decompile, or scrape the Service; circumvent technical or security protections; attempt to gain unauthorised access; introduce malware; impersonate others; or use the Service to facilitate illegal activity. The full list lives in our Acceptable Use Policy. We may remove content and suspend or terminate accounts at our discretion.
9. Subscriptions & payments
Optional paid plans are billed monthly or annually through Stripe. Subscriptions auto-renew at the then-current price until cancelled. You can cancel at any time from your profile; cancellation takes effect at the end of the current billing period and access continues until then. Refunds are at our discretion except where required by law (e.g., the EU/UK 14-day distance-selling right of withdrawal, subject to lawful exclusions for digital content already used). Taxes and currency-conversion fees are the buyer's responsibility.
10. Third-party services
The Service integrates with third-party providers (Supabase, Vercel, Stripe, Anthropic, Google, Apple, Microsoft, OpenStreetMap, Photon by Komoot, OSRM, MapLibre, Hugging Face, and others). Your use of those services is governed by their respective terms. Where you authorise sign-in via a third-party identity provider, you authorise us to receive the basic profile information made available by that provider.
11. Trademarks
"Rolls & Digs", the R&D mark, and the Service design are trademarks of Technooptics. Vehicle make / model names, manufacturer logos, and event names are trademarks of their respective owners; their appearance in the Service does not imply sponsorship or endorsement.
12. Termination
We may suspend or terminate your access to the Service if (a) you violate these Terms or any policy incorporated by reference, (b) we reasonably believe your activity is harmful to other users or our systems, or (c) we are required to do so by law or by a provider on whom we depend. You may delete your account at any time from your profile or by emailing privacy@rollsanddigs.com. Sections 5 (assumption of risk), 6 (not a safety system), 7 (content licence), 13 (indemnification), 14 (warranties), 15 (liability), 16 (governing law), and 17 (arbitration) survive termination.
13. Indemnification
You agree to indemnify, defend, and hold harmless Technooptics and our officers, employees, contractors, and partners from any third-party claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the Service, (b) Your Content, (c) your breach of these Terms or any policy incorporated by reference, or (d) your violation of any law or the rights of any third party.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, error-free, free of harmful components, or that any defects will be corrected. Any reliance on the Service is at your sole risk.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TECHNOOPTICS, ROLLS & DIGS, OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY. Our total cumulative liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 50.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability for incidental or consequential damages, so some of the above may not apply to you. Nothing in these Terms limits any non-waivable rights you have under your home jurisdiction's law.
16. Governing law & venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute not subject to arbitration is the state and federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.
17. Arbitration & class-action waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English and seated in Wilmington, Delaware (or, at your election if you are a US consumer, the county where you reside). The arbitrator — and not any federal, state, or local court or agency — has exclusive authority to resolve all disputes including the interpretation, applicability, or enforceability of this section.
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If a court holds the class-action waiver unenforceable, the rest of this arbitration provision will be deemed null and void as to the affected claim.
30-day right to opt out. You may opt out of arbitration by emailing contact@technooptics.org within 30 days of accepting these Terms with the subject line "Arbitration opt-out" and your account email.
18. Changes
We may update these Terms from time to time. If a change is material we will give you at least 14 days' notice by email and in-app banner before it takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the change, your sole remedy is to stop using the Service and delete your account.
